Continuous learning and constant updating are essential to providing comprehensive solutions to our clients. That is why, in recent months, we have conducted several internal training sessions led by the most experienced professionals at the firm.
Here are the topics covered in the latest training sessions:
Jurisdiction Clauses, led by Julieta Concetti, Senior Associate of Commercial Law, along with Associates Ramiro Musotto and Yamila di Martino. The following topics were addressed: competence and jurisdiction, international jurisdiction, general, exclusive, and concurrent forums, autonomy of will and jurisdiction extension, special interest situations, applicable law in international contracts, and the advantages and disadvantages of arbitration vs. judicial courts.
Expatriate Treatment, delivered by Felicitas de Achával and Rita Payarola, Partners in Labor and Social Security Law. Various aspects related to the assignment of employees abroad, current jurisprudence, and cases of interest where Mitrani Caballero represents different companies were examined.
Tax Aspects of M&A and Contractual Clauses, led by Corina Laudato and Juan Manuel Iglesias Mamone, Partners in the Tax Law area, with Associate Leonel Palomares. The main tax issues related to the sale and acquisition of companies were discussed, as well as the relevant contractual clauses in fiscal matters.
Social Security: Basic Concepts and Related Procedures, presented by Jorge García Rapp, who recently joined Mitrani Caballero to enhance this area. The session covered Argentina’s social security system and, particularly, the pension system, which has over 120 years of history. It was explained that the system has special characteristics, with broad coverage exceeding 90%, but with limited adequacy in benefits, as 75% of beneficiaries receive the minimum benefit. The financing is mixed (contributory and tax-based), and the existence of maximum caps, along with errors and misuse of benefit calculation mechanisms, has generated high litigation. We analyzed the causes and content of the lawsuits filed by beneficiaries.
Digital and Electronic Signatures: Concepts, Use Cases, and Recommendations, presented by María Paula Díaz, Partner in Corporate Law and Compliance, and Associate Carolina Maddalena. An overview was provided on digital and electronic signatures, their regulation both in Argentina and other countries, jurisprudential advancements on the topic, and recommendations for advising clients on the choice of signature type for documents they engage with and sign daily across various jurisdictions.
