Litigation, Arbitration and Dispute Resolution
Our Litigation, Arbitration and Dispute Resolution professionals are experts in dispute resolution and act as legal counsel in lawsuits conducted before the courts and in institutional and ad hoc arbitration proceedings before the principal domestic and international courts of arbitration. They are also very active in conflict prevention and conflict management, and have had a leading or significant role in the resolution of a number of high-profile disputes in Argentina and overseas.
Our dispute resolution work involves a broad range of areas, including litigation on civil and commercial, labor, intellectual property, regulatory and tax matters.
Commercial Litigation and Arbitration
Our commercial litigators have extensive experience in handling and managing complex civil and commercial litigation for our clients, often involving cross-border issues. We have a network of allied reputable professionals working in all provinces, which allows us to provide a complete professional support throughout the country. We have advised and represented clients in court proceedings on a variety of matters, including contract liability, shareholder conflicts, directors’ and officers’ liability, controlling companies’ liability, and bankruptcy and insolvency.
Lawyers in this practice also represent clients in arbitration, and have participated in many arbitration proceedings in Argentina, including before the Arbitral Tribunal of the Buenos Aires Stock Exchange. In addition, members of our international arbitration practice have extensive experience as counsel in arbitrations under the rules of several major international arbitral institutions (including the International Chamber of Commerce, the London International Court of Arbitration and the International Center for Settlement of Investment Disputes), and some of them act as arbitrators. They also advise on pre- and post-arbitration steps and on the enforcement and setting aside of awards.
Intellectual Property Litigation
Our intellectual property attorneys handle, among others, claims and conflicts involving:
- comparative and false advertising before Argentine and overseas courts;
- copyright infringement proceedings;
- internet and domain names, such as linking, framing and meta-tagging under the Uniform Name Dispute Resolution Policy created by ICANN, NIC Argentina and before the courts;
- patents of invention, plant patents, industrial models, designs and utility models, related to several technological industries, including telecommunications, computers, electronics and biotechnology; and
- trademarks in Argentina and in other jurisdictions, handled through our worldwide network, including, opposition procedures, infringement actions, nullity and cancellation actions and trademark misappropriation.
Labor Litigation
Our labor and social security litigators represent clients in hearings and other proceedings before labor government authorities in all kinds of labor and employment-related litigation, including wrongful and constructive discharge claims, work accident and industrial disease lawsuits, and other employment-related claims. In addition, our employment lawyers have extensive experience in managing and supervising local counsel in courts throughout the country.
Regulatory Disputes
We assist our clients in their disputes with governments and governmental agencies. We represent clients in regulatory proceedings and litigation at the local, state and federal government levels, and we also handle local and international arbitration. Our public and administrative law litigation team is particularly well suited to address a client’s administrative litigation needs, as it includes two former senior members of the Federal Administrative Court of Appeals, as well as other attorneys who have held legal roles in the federal judicial and executive branches.
Tax Litigation
Our firm represents clients in regulatory proceedings and litigation before the federal, provincial and local tax authorities and courts. Our lawyers work in close cooperation with the firm’s Public Law and Business Regulation practice, whose members are among the country’s most reputable experts in public and constitutional law and litigation. This approach strengthens our tax litigation practice and maximizes our ability to provide alternatives to clients involved in tax-related legal proceedings.
